Komerza Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("Policy") sets the rules for how merchants and users may use the Komerza platform, builder tools, and connected payment integrations. The Policy exists to protect the integrity of Komerza's infrastructure, payment partners, and other merchants using the service.

This Policy forms part of the Komerza Terms of Service. Violating it may result in immediate suspension or termination of your account without prior notice, as required by our PSPs or regulators.

2. General Conduct

Merchants must:

  • Use Komerza only for lawful business activities.
  • Comply with all applicable laws, PSP terms (e.g. Stripe, SumUp, NOWPayments, etc.), and data protection obligations.
  • Maintain accurate business, tax, and contact information.
  • Respect other users, refrain from abuse, harassment, or fraudulent behaviour.
  • Ensure all content uploaded to Komerza is lawful, original, and does not infringe the rights of others.

3. Prohibited Activities

You may not use Komerza, any merchant storefront, or related infrastructure to:

a. Illegal or Regulated Goods/Services

Sell, promote, or distribute:

  • Drugs, controlled substances, or paraphernalia.
  • Weapons, ammunition, or explosives.
  • Counterfeit goods, unlicensed software, or stolen data.
  • Gambling, betting, lotteries, or unlicensed games of chance.
  • Pornography, escort, or adult-oriented services.
  • Fake documents, hacking tools, malware, or exploits.
  • Tobacco, alcohol, or vaping products without proof of age-verification compliance.

b. Financial Misuse

  • Attempt to launder funds, use Komerza for money-muling, or disguise payment origins.
  • Collect payments without delivering goods or services.
  • Use Komerza to process payments for third parties outside your merchant account.
  • Misrepresent the nature of your business to PSPs.

c. Spam, Abuse & Misrepresentation

  • Send unsolicited commercial email or mass messages without consent.
  • Manipulate affiliate systems or referrals.
  • Impersonate another entity, individual, or merchant.
  • Use AI-generated or scraped content deceptively.

d. Security & Platform Integrity

  • Interfere with the operation of Komerza systems or networks.
  • Attempt to gain unauthorised access, probe, or test vulnerabilities.
  • Bypass rate-limits, sandbox restrictions, or API boundaries.
  • Upload or transmit malicious code or automated bots that degrade service performance.

e. Data & Privacy Violations

  • Collect buyer data beyond what is necessary for the transaction.
  • Use Komerza tools to profile, re-sell, or market buyer data.
  • Circumvent consent requirements or data deletion mechanisms.

4. Payments & PSP Compliance

When connecting to payment processors (e.g. Stripe Connect, SumUp, Authorize.net, PayPal, NOWPayments, or others):

  • You must use your own account with each PSP. Komerza does not process payments on your behalf.
  • You must comply with each PSP's acceptable use terms and KYC/KYB requirements.
  • Komerza may suspend your account immediately if instructed by a PSP or regulator, or if your activity risks platform-wide suspension.
  • Komerza is not liable for any action, delay, or termination initiated by a PSP.

5. Email & Marketing Use

If you subscribe to Komerza's Email Marketing Add-on:

  • You may only send transactional or marketing emails to recipients who have explicitly consented.
  • You must use your own verified domain; Komerza does not provide shared domains for outbound marketing.
  • Spam, phishing, or deceptive headers are grounds for immediate termination.

6. AI Builder and Automated Content

Komerza's AI Builder may generate website layouts, text, or design assets. Merchants are responsible for reviewing and editing all generated content to ensure:

  • It does not infringe intellectual property rights.
  • It complies with advertising, consumer-protection, and truth-in-marketing laws.
  • It does not mislead users or promote illegal activity.

Komerza is not liable for any consequences arising from the use of AI-generated content.

7. Enforcement

Violations may result in:

  • Immediate suspension or termination of your account.
  • Blocking of storefront domains or hosting infrastructure.
  • Reporting to PSPs, law enforcement, or regulators where required.
  • Loss of access to any stored or deployed projects.

Komerza reserves the right to determine, in its sole discretion, what constitutes a violation.

8. Reporting Abuse

If you encounter a merchant misusing Komerza or hosting illegal material, please report it to abuse@komerza.com with relevant evidence (URLs, screenshots, order IDs). Reports are reviewed promptly by our compliance team.

9. Updates

We may amend this Policy from time to time to reflect new PSP rules or regulatory guidance. Material changes will be announced through the dashboard or via email at least 15 days in advance.
